Legal Dream Team Earns Big Win with "No Probable Cause" Ruling

Last week, a 6-day preliminary hearing to find probable cause to try 3 HPD officers in the shooting of Iremamber Sykap concluded; no probable cause was found to take the case to trial. This was the second ruling in favor of the three after an Oahu grand jury declined to indict the officers involved.

Key to the issue, was whether lethal force was justified when the car driven by Sykap may or may not have put the officers' lives in danger.

“The danger is always present and whether or not someone is directly in front of the car or to the side, the term that was used was the zone of danger at this stage, and the car was not on rails, where it was set and could only go in one way.” Judge Domingo said.

Attorney Thomas Otake has racked up several signature wins over the past few years. Most notably:

1) Winning the second Christopher Deedy Murder case

2) Successfully challenging the 22 vote win by Trevor Ozawa forcing a rematch election ultimately won by challenger Tommy Waters

3) No probably cause ruling for The Three

Attorney Rick Sing also adds another signature win to his resume. Mr. Sing is best known for his high profile win in the Billy Kenoi P-card scandal case.

In an internal message obtained by the Honolulu Star Advertiser, City Prosecutor Alm said:


“When I announced that this office would conduct independent, objective investigations of all officer- involved shootings, I knew that there would be some people who would be unhappy if we ever found a shooting to be an unjustifiable use of deadly force and proceeded with a prosecution. Some of you may have heard such criticism and I know that must have been difficult to hear. Nevertheless, it is our obligation as ethical, responsible prosecutors to proceed with a case if the facts warrant it, as they did in the Sykap matter. We are here to do the right thing, not the easy thing. And I know you are too.”
