Bail Denied: Gerhardt Konig Held Without Release

Serving Families Throughout Honolulu

📰 Jail Mail — Special Bail Report Issue 💯

In a closely watched bail hearing this month, Circuit Court denied bail for Dr. Gerhardt Konig, a licensed anesthesiologist accused of attempted murder. The case raises sharp questions about judicial discretion, prosecutorial framing, and how Hawaii applies HRS §804-3 when pretrial detention is on the line.

⚖️ The Charges

AI rendition of “If she had just taken the selfie.”

Dr. Konig is charged with attempted murder in the second degree for allegedly assaulting his wife during a hike at the Pali Lookout. The state claims he:

  • Tried to throw her off a cliff,

  • Attempted to stab her with syringes,

  • And struck her with a lava rock.

🎤 Defense Argument: No Bail is Arbitrary & Excessive

Attorney Thomas Otake argued:

  • No prior record and a long career in medicine.

  • Syringes were never recovered, and the cliff allegation is inconsistent with police reports.

  • ER doctors documented no concussion, no substantial risk of death, and only injuries consistent with assault in the second degree.

  • Highlighted that bail is routinely granted in similar cases.

  • Proposed $100K–$200K bail, citing:

    • A divorce-triggered asset freeze,

    • Willingness to stay on O‘ahu,

    • Use of electronic monitoring is required.

🔒 Prosecution’s Counter: Risk to Victim & Flight

Deputy Prosecutor Joel Garner offered a starkly different view:

  • Konig allegedly hid in the forest for 8 hours after the incident.

  • Told his son over FaceTime that he “tried to kill” his wife and turned off his phone and destroyed the SIM card to avoid police.

  • Resisted arrest when captured.

  • No strong ties to O‘ahu, with international family connections.

  • Argued that his access to anesthetics like Propofol, stored improperly at home, underscores dangerousness.

🧑‍⚖️ The Court’s Decision

After reviewing the filings and arguments, the court:

  • Found sufficient evidence of both flight risk and danger to the victim,

  • Ruled that Konig met the criteria under HRS §804-3 for bail denial,

  • Ordered continued detention without bail.

🧠My Hot Take

If you’ve been following only the headlines, you’ve missed the real story. The JDPC itself contradicts the now-popular narrative that this was a dramatic attempt to throw a woman off a cliff over a selfie. What it actually describes is an alleged assault that began with a push into the bushes—away from the cliff’s edge—and escalated into a physical struggle involving a lava rock that was later recovered by HPD.

JDPC - page 1

Yet despite claims of an attempted injection, not a trace of syringe-related materials was ever found on Oahu: no syringes, no needles, no plungers, no vials, and no eyewitness to the alleged injection attempt. If a healthy 46-year-old man truly struck someone ten times in the skull with a jagged lava rock, it defies logic that the only visible injury weeks later would be a superficial scar.

And the fact that the only syringes were found days later, not at the scene, not at the hotel, but at the defendant’s home on Maui, should raise eyebrows. If this case is about truth, not theater, then someone needs to start asking why the evidence doesn’t line up with the story being sold.

🔥 Direct and Bold:

I’m calling my shot:
This case looks far more like a domestic violence incident—something closer to Assault in the Second Degree—than the Attempted Murder charge it’s been dressed up as.
